Terms of Service

1. Acceptance of Terms

By accessing or using CRMFinity AI ("the Platform"), operated by LinkSwitch Communications, you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Platform.

2. Description of Service

CRMFinity AI is a SaaS platform that provides AI-powered bank statement analysis, cash flow underwriting, and MCA (Merchant Cash Advance) deal management tools. Features include:

• Automated bank statement parsing and transaction analysis
• AI-generated underwriting summaries and cash flow reports
• Lender matching and MCA qualification tools
• Team collaboration and organization management
• API access for programmatic integration

3. Account Registration

To use the Platform you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Promptly notify us of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Upload documents you do not have authorization to process or share
• Use the Platform to commit fraud, money laundering, or any illegal activity
• Attempt to reverse engineer, decompile, or extract proprietary algorithms from the Platform
• Scrape, crawl, or use automated tools to extract data from the Platform without prior written consent
• Upload malicious files, viruses, or any content designed to disrupt the Platform
• Share API credentials or account access with unauthorized third parties
• Circumvent subscription limits, usage quotas, or access controls

5. Uploaded Documents & Data

You retain ownership of any documents and data you upload to the Platform. By uploading content, you grant us a limited license to process and store that content solely for the purpose of providing the service to you.

You represent and warrant that:

• You have the legal right to upload and process the documents you submit
• The documents do not violate any applicable laws or third-party rights
• You have obtained any necessary consents from individuals whose financial data is contained in uploaded documents

We are not responsible for the accuracy of AI-generated analysis. All outputs should be reviewed by a qualified professional before being used for financial decisions.

6. Subscription & Billing

Access to the Platform is provided on a subscription basis. By subscribing, you agree to:

• Pay all applicable fees for your chosen plan in advance on a monthly or annual basis
• Authorize us (via Stripe) to charge your payment method on a recurring basis
• Provide accurate and up-to-date billing information

All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

Failure to pay may result in suspension or termination of your account.

7. Free Plan & Trial

We may offer a free plan with limited features and usage. Free plan users agree that:

• Features and limits on the free plan may change at any time
• We may discontinue the free plan with reasonable notice
• Data from free accounts that are inactive for 12 months may be deleted

8. Intellectual Property

All software, algorithms, designs, trademarks, and content comprising the CRMFinity AI Platform are the exclusive property of LinkSwitch Communications or its licensors. Nothing in these Terms transfers any intellectual property rights to you.

You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.

9. AI-Generated Outputs & Disclaimer

The Platform uses artificial intelligence to analyze financial documents and generate reports. You acknowledge that:

• AI-generated outputs are for informational purposes only and do not constitute financial, legal, or lending advice
• Analysis results may contain errors or inaccuracies and should be independently verified
• We are not liable for any lending decisions, financial losses, or damages arising from reliance on AI-generated outputs
• You are solely responsible for any decisions made based on the Platform's analysis

10. Confidentiality

We treat all uploaded financial documents and analysis results as confidential. We will not share your organization's data with other organizations or use it to train public AI models without your explicit consent.

11. Limitation of Liability

To the maximum extent permitted by applicable law, LinkSwitch Communications shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Platform.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the fees paid by you in the three months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless LinkSwitch Communications and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

13. Termination

You may cancel your account at any time from the billing settings. We may suspend or terminate your account immediately if:

• You violate these Terms
• We are required to do so by law
• Your account poses a security or legal risk to the Platform or other users

Upon termination, your right to access the Platform ceases immediately. Your data will be deleted in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which LinkSwitch Communications operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
